Political implications following the Supreme Court of Justice's decision to order the pre-trial detention of former President Álvaro Uribe Vélez.
With a historic decision, for the first time a former president has been deprived of his freedom by the Supreme Court of Justice. Álvaro Uribe Vélez, the protagonist of Colombian political life in the last 20 years, now faces a precautionary detention, preventive and at home., within the framework of the investigation that is proceeding in the Instruction Chamber for the crimes of bribery and procedural fraud.
A political control debate in 2014 about the former president's alleged links to paramilitary groups kicked off the controversy. Senator Iván Cepeda of the Polo Democrático, along with then-Senator Claudia López (Alianza Verde), led a historic debate that virtually welcomed the former president back to the Senate. The discussion moved to the courts.
The decision, which today has a first outcome, dates back to 2018, when the Supreme Court received a complaint from Uribe against Cepeda. But the investigations – promoted by the accuser – gave the court indications that it was not Iván Cepeda who was trying to manipulate witnesses, but Álvaro Uribe. An entire investigative process was launched from then on.
The path was paved with accusations and tests that arose from one side to another, until, in October 2019, Álvaro Uribe was linked to crimes of bribery and procedural fraud. While the legal process continues and a final sentence is issued, the leader of the Democratic Center party is sidelined from national political activities, implying a severe blow to the Colombian right.
It has been a harsh and exhausting process for many, where interpretations often flood the context. Many believe that Álvaro Uribe's differences with the Supreme Court of Justice date back to when the then-President of the Republic clashed with the Court, because it was pointing to his officials and congressmen for various crimes. However, the magistrates who, at that time, were distant from Uribe's actions are no longer part of the highest court.
It seems that a new chapter is beginning in Álvaro Uribe's history with the Supreme Court of Justice. The five magistrates, who took the historic decision unanimously, ignited national political debate with a measure whose necessity regarding house arrest is being questioned and giving way to all sorts of interpretations, from a legal analysis grounded in law to a decision of a political nature aimed at removing him from the national political scene.
Implications of the ruling
The repercussions of the measure are of deep insight into national events and generates an earthquake in the country's ideological checks and balances system.
The first implication of the recent measure in signal and as a preamble to the decision the Court would make, relates to the resounding message issued on August 3rd by the entire judiciary, through a statement in which it highlighted its independence, as well as its autonomy in the exercise of its power.
The second, and no less important, is related to the end of the myth that has prevailed in Colombia for decades; related to the discretion or carte blanche regarding the responsibility for irregularities that high-ranking officials of the country may have committed, as happened in the case of Ernesto Samper Pizano. This premise could gain more traction as investigations into other dignitaries advance without distractions. In this way, it can be affirmed that today's decisions represent progress in national justice.
The third implication of this decision directly relates to the deepening division and polarization of Colombian society regarding the Havana Accords. The country still hasn't managed to move on, and with this ruling, sentiments are exacerbated regarding how the FARC have transitioned to the democratic system, enjoying the benefits of the concessions granted in the agreement without fulfilling their promises concerning the Special Jurisdiction for Peace (JEP), and openly lying about the atrocities they committed over years of conflict.
The fourth implication is related to the strengthening of the left in Colombia, where figures like Gustavo Petro will know how to capitalize the situation to their advantage in the upcoming elections, taking advantage of the absence of clear leadership on the Colombian right, as a consequence of its inability to form and generate political renewal. Political parties are discredited, the center today lacks a figure that represents them or generates identity with the citizenry, presenting us with a perfect breeding ground for populism.
Regarding the government, this coup undoubtedly impacts President Iván Duque and affects his leadership. The atmosphere in Congress will be heated regarding the legislative agenda presented by the government, with such important proposals as labor, economic, and pension issues, to name a few.
Duque will have to navigate the situation by forging a party alliance aimed at calming the waters politically, with the objective of getting through the pandemic without the healthcare system collapsing, while simultaneously managing to reactivate employment and the economy.
Regarding the Democratic Center, until a definitive verdict is reached in Álvaro Uribe's case, the "silla vacía" (empty seat) cannot be decreed, and therefore, with the preventive measure, the party retains its seat in Congress. The seat will be held by the next candidate, who in this case is Milla Patricia Romero from Norte de Santander, who narrowly missed reaching the Senate by 93 votes in the last election.
Given the current context, Colombia is going through one of the most complex political chapters in its recent history, putting its society's mettle to the test. It is therefore tasked with demonstrating its greatness in navigating the implications of this measure, as well as the continuity in the implementation of the peace agreement.
